| With a date of 28/06/2004 (S/REF.: JAL/CTM) we
received this reply from the Spanish Foreign Ministery (Ministerio de Asuntos
Exteriores, Direccion General de Asuntos y Asistencia Consulates, Subdireccion
General de Asuntos de Extranjeria). "In relation to your letter sent to the Ministry it seems from you text and, especially from the letters from the department of Social Services in the Junta of Andalucía, that what you and your wife are attempting, is to adopt IN COLOMBIA, two Colombian children, through the application of Colombian law and Spanish law for International adoption for Spanish nationals, and this on the basis that you are not Spanish nationals but are European community residents in Spain. Although, in this case it appears that the natural law of the child and your own natural law should be applied according to your nationality, to be more certain we suggest you consult your case with the Ministry of Justice. Once the adoption has taken place and the relation between adopters and adopted has been established the normative would be applied for the entrance of the latter into Spain." We understand this letter to indicate that the Ministry sees no place for Spanish law in the procedure outlined above, only Colombian and Irish or British. We have replied to this letter, seeking clarification, explaining that we are not asking for Spanish Nationality for our adopted children, rather the right to enter Spain and asking how the Ministry interprets the Hague Convention, signed and ratified by Spain, to which they make no mention in their correspondence.
